Artvoice assoc. editor Buck Quigley caught up with Ralph Hernandez as he turned in his petitions today at the Erie County Board of Elections to run for the Erie County Legislature District 6 seat, currently occupied by Democratic Majority Leader Maria Whyte. Hernandez, who currently serves on the Buffalo School Board and was recently voted board president, says he will continue on in that capacity, regardless of the outcome of the county race.
Some have questioned the legality of an elected official running for another political office, to which Hernandez cites Informal Opinion No. 82-1 offered by the NYS Attorney General in 1982. The opinion states that "One person may simultaneously serve as a member of the board of education of a central school district and as a member of the county legislative body in which the school district is located."
